Rixton and Warburton Bridge Order - TWAO Application – Update
MSCC made an application on 30 November 2021 to the Secretary of State for Transport for the proposed Order to be made under the Transport and Works Act 1992.The objection period in respect of the Order closed on 18 January 2022.
MSCC has carefully considered feedback received and prepared a response to the key issues set out in TWAO Representations – Applicant’s Response Report, May 2022 which is available here.
In accordance with Rule 7(1) of the Inquiry Rules, MSCC are required to provide a Statement of Case by 10 May 2022. This is a statement of the case that MSCC intends to make at the forthcoming public inquiry into the proposed Order. The Statement of Case is available here. It includes, at Appendix 1, a list of the documents referred to within the Statement. These documents are also set out and can be accessed below.
These documents are available for inspection at the locations and times set out in Appendix 2 of the Statement of Case, from 10 May 2022 until the start of the public inquiry. Documents served on MSCC by others are available below.

Rixton and Warburton Bridge Order - TWAO Application
Please note that the objection/representation period in respect of our application to the Secretary of State for Transport under the Transport and Works Act 1992 for the proposed Rixton and Warburton Bridge Order closed on 18 January 2022.
The Secretary of State will now decide the procedure for considering any objections, which may be done in the following ways:
- by causing a public inquiry to be held;
- by affording the opportunity of a hearing; or
- by exchanging written representations between the parties.
Once the Secretary of State has decided which procedure to follow, the Transport Infrastructure Planning Unit will inform the applicant, objectors and people who have commented of the decision.
If an inquiry or hearing is to be held, MSCC will advertises the date, time and venue in local newspapers and will also publish the details on this website.
